Procedural Posture

Divorce Cause / Judgment

  1. 1 Whether the marriage between the Petitioner and the Respondent has irretrievably broken down.
  2. 2 Whether the ground of constructive desertion has been established to warrant dissolution of the marriage.
  3. 3 Whether the parties have made adequate arrangements for the maintenance and education of the children.

Ratio Decidendi

The court found that the marriage between the Petitioner and the Respondent had irretrievably broken down, with the parties having been separated for more than three years. The evidence established constructive desertion as the operative ground for dissolution. The court noted that the parties had agreed to contribute to the maintenance and education of their children, and that there was no reasonable prospect of reconciliation. Accordingly, the court granted the petition for divorce, issued a decree nisi to be made absolute after thirty days, and made no order as to costs.
