Procedural Posture

Originating Summons / Ruling on Interlocutory Application

  1. 1 Whether the Plaintiffs have established a prima facie case for grant of interlocutory injunction and inhibition orders over land parcel Embu/Gangara/3299.
  2. 2 Whether the Plaintiffs are entitled to be registered as absolute proprietors of the suit property by adverse possession.
  3. 3 Whether the Plaintiffs are entitled to costs of the application.

Ratio Decidendi

The Plaintiffs failed to demonstrate a prima facie case with a probability of success as required for interlocutory injunctions. The sale agreement relied upon by the Plaintiffs did not specify the acreage or parcel, nor was there evidence of full payment or possession. The Plaintiffs did not provide credible evidence of occupation or development of parcel 3299, and both the Defendant and the vendor denied their claims. The Plaintiffs also failed to disclose material facts at the ex-parte stage, including their ownership of a neighboring parcel and the Defendant's legitimate purchase. This lack of candor and material non-disclosure further disentitled them to equitable relief....

Court Disposition

Plaintiffs' application dismissed with costs; interim orders discharged.

Orders
