The court found that the plaintiff filed the application for stay of execution in the High Court after the Court of Appeal had already issued directions on a similar application, and only withdrew the appellate application after seeking ex-parte orders in the High Court. The court determined that the plaintiff failed to make full and frank disclosure of these facts, thereby misleading the court and abusing the process.
