Procedural Posture

Cause / Ruling on Preliminary Objection (notice of Motion to Strike Out Suit)

  1. 1 Whether the suit discloses a cause of action in light of the alleged reinstatement of the claimant.
  2. 2 Whether the dispute on reinstatement is a contested matter of fact requiring trial.
  3. 3 Whether the suit should be struck out at the preliminary stage.

Ratio Decidendi

The court found that the respondent's claim of reinstatement and the claimant's denial thereof raised contested matters of fact. Such disputes cannot be resolved at the preliminary stage through affidavit evidence but must be tested at a full trial. Striking out a suit on the basis of contested facts would not serve the interests of justice. Therefore, the application to strike out the suit for lack of cause of action was without merit and was dismissed with costs to the claimant.

Court Disposition

Application to strike out suit dismissed with costs to the claimant. Suit to proceed to hearing.

Orders
