The court found that the trial court failed to comply with the mandatory requirement under Section 333(2) of the Criminal Procedure Code to consider and deduct the period the applicant spent in custody prior to sentencing. The applicant was in custody throughout the trial as he did not post bond, yet the sentencing order did not account for this period. The court held that this omission entitled the applicant to a review of his sentence. Accordingly, the court set aside the original sentencing order and substituted it with an order that the applicant's fifteen-year imprisonment sentence would run from the date of his arrest, thereby giving full effect to the period already spent in custody.
