The court found that the applicant had satisfied the requirements for stay of execution pending appeal as set out in Order 42 Rule 6(2) of the Civil Procedure Rules. The application was filed without unreasonable delay, and the applicant was willing to provide security by depositing the decretal sum. Although the respondent was employed, the court held that refunding the decretal sum could be challenging for any salary earner, and thus the applicant risked suffering substantial loss if stay was not granted. The court determined that a fair balance would be achieved by ordering payment of half the decretal sum to the respondent and securing the remaining half in a joint interest earning...
