Ratio Decidendi

The Court of Appeal held that the applicants had demonstrated an arguable appeal, particularly on the issue of whether section 93(1) of the Law of Succession Act protected the sale and transfer of the suit property to the 1st applicant, despite the subsequent revocation of the grant. The court further found that unless a stay of execution was granted, the appeal would be rendered nugatory because the suit property would be distributed to the beneficiaries of the deceased’s estate before the appeal was heard and determined. Accordingly, the court granted the stay of execution as sought by the applicants.
