The court found that at the time the suit was filed, both the Applicant and the child resided in Nairobi, making the Tononoka Children Court in Mombasa lack territorial jurisdiction under section 15 of the Civil Procedure Act. The best interest of the child, who is of a delicate age, would be served by having the matter heard in Nairobi, where she resides with the Applicant. While virtual hearings are common, physical attendance may still be required, and requiring the Applicant and child to travel to Mombasa would be disruptive and not in the child's best interest.
