The Act expressly excludes tenancies where the government is a party from the definition of controlled tenancy. Since the respondent landlord is a government entity, the tenancy in question does not qualify as a controlled tenancy. Consequently, the Tribunal lacks jurisdiction to hear and determine the reference. The preliminary objection raised by the respondent was therefore upheld, and the reference was struck out with costs awarded to the respondent.
