Ratio Decidendi

The court held that there is no legal provision allowing for the direct substitution of a single deceased administrator or executor in succession proceedings. When the sole administrator dies, the existing grant becomes inoperative and must be revoked under section 76(e) of the Law of Succession Act. Only after revocation can a fresh grant of letters of administration de bonis non be issued. The applicant's request for direct issuance of a grant de bonis non without first revoking the previous grant was therefore procedurally and legally untenable. The application was dismissed on this basis.
