The court found that there was insufficient and inconsistent evidence to prove that the deceased distributed his land during his lifetime. The protestors failed to discharge the burden of proof, and their omission to call a key witness (their father) was deemed deliberate and adverse to their case. The court held that, even if customary law were to apply, any custom that results in unequal or discriminatory distribution among children is repugnant to justice and morality and cannot be upheld.
