Legal Issues
- 1 Whether the necessary original documents and reports have been filed to support the adoption application.
- 2 Whether the court can proceed to judgment in the absence of original documents and reports.
Ratio Decidendi
The court cannot proceed to judgment in an adoption matter where the original documents, including the report on the child, the applicant, and the certificate freeing the child for adoption, have not been filed. The absence of these documents is a procedural deficiency that must be rectified before the court can consider and determine the application. The Child Welfare Society of Kenya, as the adoption society arranging the adoption, is directed to file the original documents within sixty days to enable the court to proceed with the matter.
Court Disposition
Judgment deferred; applicant directed to file original documents within 60 days.
Orders
- The Child Welfare Society of Kenya shall cause its original documents to be placed in the court file in the next sixty (60) days of date hereof.
- The matter shall be mentioned thereafter for further directions.
