The court found that while the applicant had complied with the requirements for a bankruptcy petition under Section 32 of the Insolvency Act, the application for a stay of proceedings prior to the issuance of a bankruptcy order was misconceived. The statutory framework under Section 48(1)(a) provides that a stay of proceedings to recover debts only takes effect upon the making of a bankruptcy order, not before. Furthermore, Rule 10(1) of the Insolvency Regulations expressly excludes bankruptcy petitions from its ambit.
