The court found that the Kadhi’s Court’s jurisdiction is strictly limited by Article 170(5) of the Constitution and Section 5 of the Kadhi’s Courts Act to matters of Muslim law relating to personal status, marriage, divorce, or inheritance, and does not extend to children’s matters such as custody and maintenance. The Children Act vests exclusive jurisdiction over such matters in the Children’s Court, and there is no provision for the Kadhi’s Court to hear them. Furthermore, the applicant did not submit to the jurisdiction of the Kadhi’s Court, which is a constitutional prerequisite.
