Miscellaneous Application / Judgment

  1. 1 Whether the Supreme Court of India judgment can be registered and enforced in Kenya under the Foreign Judgments (Reciprocal Enforcement) Act.
  2. 2 Whether India is a reciprocating country under the Act for purposes of enforcement of foreign judgments in Kenya.
  3. 3 Whether the Act applies to judgments relating to the custody or guardianship of children.

Ratio Decidendi

The court held that the Supreme Court of India is not a designated court under the Foreign Judgments (Reciprocal Enforcement) Act because India is not a reciprocating country as declared by the Minister under Section 13(1) of the Act. Furthermore, even if India were a reciprocating country, Section 3(3)(e) of the Act expressly excludes judgments relating to the custody or guardianship of children from the scope of the Act. Therefore, the court lacks jurisdiction to register or enforce the Indian custody judgment. The application was dismissed for lack of merit, with no order as to costs given the matter concerns a child.
