Ratio Decidendi

The court found that the applicants had satisfied all legal requirements for adoption under the Children Act, 2022. The child was abandoned and all efforts to trace the biological parents were unsuccessful, justifying the dispensation of parental consent. The child was declared free for adoption by a registered adoption society, and the applicants were found to be suitable adoptive parents by both the guardian ad litem and the Director of Children Services. The court determined that the adoption was in the best interests of the child, as required by the Constitution and statute, and therefore allowed the application.
