Ratio Decidendi

The court found that Immaculate Nguku Wanyanga was not a wife of the deceased for purposes of the Law of Succession Act, as she conceded she was not married to the deceased under customary law and did not attempt to prove such a marriage. Therefore, she could not be deemed a wife or a dependant under sections 3(5) and 26 of the Act. As for the children, the court held that Kihagi Mathenge Muriuki was a natural child of the deceased, recognized and accepted by the deceased, who had assumed permanent responsibility for him. Thus, he qualified as a dependant under section 29(a) of the Act, regardless of legitimacy or maintenance prior to death. Lucina Mithayo Wanjeri, however, was not proved...
