  1. 1 Whether the court should order a specific date of birth for the abandoned child to facilitate issuance of a birth certificate.
  2. 2 Whether the child should be presumed Kenyan by virtue of abandonment within Kenya.

Ratio Decidendi

The court found that, in the best interests of the child, it was necessary to order a specific date of birth to facilitate the issuance of a birth certificate, as the child had been abandoned and no official record of birth existed. The court further held that the child, having been found abandoned within the Kenyatta National Hospital compound in Nairobi County, should be presumed Kenyan. These orders were made to ensure the child could be properly registered and integrated into society, in accordance with the principles of the Children Act, 2001.
