The court held that although the applicant is the only proved creditor and the Official Receiver has acknowledged receipt of the funds, the Official Receiver is legally obligated to comply with the statutory procedures under the Bankruptcy Act and Rules before making any payment. This includes gazetting the intention to declare a dividend and observing the statutory notice period, after which payment can be made to the creditor, less statutory charges. The court found no justification to compel immediate payment in contravention of these legal requirements and ordered the Official Receiver to proceed with the statutory process without undue delay.
