Legal Issues
- 1 Whether DKK is mentally incapacitated and unable to manage his affairs.
- 2 Whether the applicant should be appointed as administrator of DKK's estate.
Ratio Decidendi
The court found, based on the psychiatric report, the Chief's letter, family meeting minutes, and consents from all siblings, that DKK is suffering from a mental disorder (schizoaffective disorder) and is incapable of managing his affairs. The applicant, RJK, demonstrated that she is suitable and has the support of the family to act as administrator. The legal requirements under the Mental Health Act were satisfied, justifying the declaration of incapacity and the appointment of the applicant as administrator of DKK's estate for the benefit of DKK and his beneficiaries, subject to periodic accounting as required by law.
Court Disposition
application allowed; applicant appointed as administrator of DKK's estate
Orders
- DKK declared unfit to manage his estate.
- RJK appointed as administrator of the estate of DKK.
