Ratio Decidendi

The court found, based on medical evidence and the testimony of the applicant and other family members, that DOO suffers from dementia and schizophrenia, which constitute mental disorders under the Mental Health Act. The court observed DOO and noted his inability to comprehend or communicate. All children of DOO consented to the application. The court was satisfied that DOO is incapable of managing his affairs and that MAO, being the only child residing in Kenya and with the support of her siblings, is a suitable person to be appointed as Guardian and Manager of DOO's estate. The statutory requirements under section 26 of the Mental Health Act were met, justifying the orders sought.
