Ratio Decidendi

The court found, based on the uncontroverted medical evidence and its own observation, that DMK suffers from severe cognitive impairment and is incapable of managing her own affairs. The Mental Health Act empowers the court to appoint a guardian and manager for such a person. The applicant, being the eldest child and with the consent of all siblings, is a suitable person to be appointed. The court therefore appointed MNK as guardian ad litem and manager of DMK's estate, with powers necessary for management but excluding alienation, sale, or transfer of immovable assets without leave of court.
