Judgment
1. The petitioner herein filed this petition on 24/6/2019 seeking to act as Legal Guardian of ECK. The petitioner also prayed to be allowed to manage all property and assets of ECK by collecting, maintaining and doing all that is in pertaining the preservation of the assets.
2. The assets are listed in paragraph 8 of the petition as follows: -a.LOC.5/Mariaini/xxxx.b.LOC.5/Ngurweini/xxxx.c.Wakibui Help Group Investments Share Number xxxx Plot Number xxxx(RR).
3. From the averments herein, the petitioner is the only surviving close relative of the subject being the only sibling alive having lost her only brother PGK as indicated in paragraph 3 of the petition.
4. I have perused the medical report dated 3/10/2019 attached to further affidavit. The report indicate that the subject is mentally retarded with no insight of good judgment; that she has moderate intellectual disability and is on follow up for convulsive disorder.
5. The report indicates that the subject lives in [particulars witheld] , Nairobi County with a caregiver and is supported by the elder sister LNK who is the petitioner herein.
6. From the averments and the medical report filed, I am satisfied that the subject is not able to manage herself and her assets and the application by her sister, the petitioner herein is merited.
7. I therefore, allow this petition.
8. Final Orders;1. I hereby appoint the petitioner herein LNK as Legal Guardian of the subject herein ECK.2. The petitioner is hereby allowed to manage all the property and assets of the subject ECK by collecting, maintaining and preserving the said assets/properties for the benefit of the subject ECK.3. The petitioner is authorized to use income derived from the properties listed below: -a.LOC.5/Mariaini/xxxx.b.LOC.5/Ngurweini/xxxx.c.Wakibui Help Group Investments Share Number xxxx Plot Number xxxx(RR) for the benefit of the subject ECK.**4. Period reports on management of assets/accounts to be filed as required by law.5. Costs in the cause.
