Ratio Decidendi

The court found, based on the uncontroverted medical evidence from Dr. K. Ndege and the supporting affidavits, that J K K suffers from a mental disorder as defined by the Mental Health Act. The court was satisfied that she is incapable of managing her personal and financial affairs. The applicants, being her children, have demonstrated their ability and willingness to care for her, and all other adult children have consented to their appointment. There was no opposition or evidence to the contrary. The court therefore concluded that it is in the best interests of J K K for E M K and G J O K to be appointed as her guardians and estate managers, as provided by law.
