The High Court found that the trial Magistrate erred in distributing the estate of Joash Arende under the Law of Succession Act, as the deceased died before the Act's commencement date of 1 July 1981. Section 2(2) of the Act mandates that estates of persons who died before its commencement are to be distributed according to the written laws and customs in force at the time of death, in this case, Luo Customary Law.
