The court found that although the gazette notice for the application for grant contained an error, it was a technicality that did not prejudice the Applicant, as the notice otherwise contained sufficient information and fulfilled statutory requirements. However, the confirmation of the grant was found to be defective in substance because the Applicant, a dependant, was not notified, his consent was not sought, and he did not participate in the confirmation proceedings, contrary to Rule 40(8) of the Probate and Administration Rules.
