Legal Issues
- 1 Whether the grant of letters of administration can be confirmed before the lapse of six months from issuance.
- 2 Whether the distribution of the estate should follow the determination of the Kadhi's court under Islamic Law.
Ratio Decidendi
The court exercised its discretion to confirm the grant of letters of administration before the statutory six-month period had lapsed, on the basis that the estate consisted solely of funds required for the immediate welfare of minor heirs, specifically for payment of school fees. The court further held that the distribution of the estate should follow the determination made by the Kadhi's court under Islamic Law, in accordance with the Law of Succession Act provisions applicable to Muslims. The application for confirmation was thus allowed, and a certificate of confirmed grant was ordered to issue.
Court Disposition
Application for confirmation of grant allowed.
Orders
- Letters of administration confirmed.
- Distribution to be as determined by the Kadhi's court under Islamic Law of inheritance.

REPUBLIC OF KENYA
IN THE HIGH COURT OF KENYA AT GARISSA
SUCCESSION CAUSE NO. 40 OF 2015
IN THE MATTER OF THE ESTATE OF ABDULLAHI KALA HAPI (DECEASED).
RULING
This is a summons for confirmation of grant dated 29th August 2016 filed by the Assistant Public Trustee.
Though the application was filed before the lapse of six(6) months from the time the initial grant of letters of administration was issued on 13th July 2016, as Mr. Miyogo has explained to court that the heirs include minors who required payment of school fees from the funds, which is the only asset, I allow the application. I thus confirm the letters of administration herein. The distribution will be as has been determined by the Kadhi’s court under Islamic Law of inheritance.
Certificate of confirmed grant to issue.
Dated and delivered at Garissa this 20th September 2016.
