Succession Cause / Ruling on Summons for Confirmation of Grant

  1. 1 Whether the grant of letters of administration can be confirmed before the lapse of six months from issuance.
  2. 2 Whether the distribution of the estate should follow the determination of the Kadhi's court under Islamic Law.

Ratio Decidendi

The court exercised its discretion to confirm the grant of letters of administration before the statutory six-month period had lapsed, on the basis that the estate consisted solely of funds required for the immediate welfare of minor heirs, specifically for payment of school fees. The court further held that the distribution of the estate should follow the determination made by the Kadhi's court under Islamic Law, in accordance with the Law of Succession Act provisions applicable to Muslims. The application for confirmation was thus allowed, and a certificate of confirmed grant was ordered to issue.

Court Disposition

Application for confirmation of grant allowed.

Orders

  • Letters of administration confirmed.
  • Distribution to be as determined by the Kadhi's court under Islamic Law of inheritance.
