Ratio Decidendi

The court found, based on uncontroverted evidence from the petitioner's grandmother and corroboration by the area chief and elders, that plot No. 651 originally belonged to the late Alike Kotoma, the 1st respondent's father. The petitioner's father and his siblings were not biological children of Alike Kotoma but were raised by him after he married their mother. Under Islamic law, only biological children and spouses are entitled to inherit. Therefore, the only legal heirs to the estate are the 1st respondent and her mother, Mrs. Bilach Galgallo. The petitioner's claim to the estate was dismissed for lack of merit, and the distribution of the plot was ordered accordingly.
