Ratio Decidendi

The court found that the advocate for the deceased petitioner lacked the necessary capacity or standing to bring the application after the petitioner's death, as there had been no substitution. Consequently, the petition and all related applications abated with the death of the petitioner. Any orders previously made in the matter, including temporary injunctive relief, were rendered moot. Furthermore, the grant issued to the objector by the magistrate's court was obtained irregularly while the initial grant to the petitioner was still subsisting and had not been revoked. Both grants, therefore, were revoked: the initial grant due to abatement and the subsequent grant due to irregularity....
