Procedural Posture

Succession Cause / Ruling

  1. 1 Whether a single succession cause can be maintained for the estates of two deceased individuals.
  2. 2 Whether administration and distribution of estates held in tenancy in common must be conducted separately for each deceased's share.

Ratio Decidendi

The court held that succession proceedings cannot be combined for two deceased individuals, even where they jointly owned property. Each estate must be administered and distributed through a separate succession cause, particularly where the property was held in tenancy in common, with each deceased entitled to a distinct share. The current proceedings, which purported to administer both estates together, were irregular and contrary to established legal principles and precedent. The court directed that the administration of the two estates be separated and that distribution be conducted in separate proceedings, in line with prior judicial guidance and the nature of tenancy in common.

Court Disposition

Administrations of the two estates must be separated; distribution to be done in separate proceedings.
