Procedural Posture

Succession Cause / Ruling on Interlocutory Application for Injunction Prior to Confirmation of Grant

  1. 1 Whether the applicant has locus standi to seek injunctive relief in respect of the estate property.
  2. 2 Whether the applicant qualifies as a dependant or beneficiary under the Law of Succession Act.
  3. 3 Whether the applicant is entitled to an injunction restraining the respondents from dealing with the estate property pending confirmation of grant.

Ratio Decidendi

The applicant failed to demonstrate that he is a beneficiary or dependant of the deceased as required under Section 29 of the Law of Succession Act. There was no evidence that the applicant was maintained by the deceased or otherwise entitled to participate in the succession proceedings. The applicant's claim to the estate property, if any, should be pursued in a separate civil suit and not within the succession cause. The applicant therefore lacks locus standi to seek injunctive relief or participate in the administration of the estate. The application for injunction is without merit and is dismissed with costs.
