Succession Cause / Ruling on Application for Rectification of Grant

  1. 1 Whether the application for rectification of grant is merited under section 74 of the Law of Succession Act and rule 43(1) of the Probate and Administration Rules.
  2. 2 Whether the omission to specify the acreage for the petitioner constitutes an error justifying rectification of grant.
  3. 3 Whether the applicant is in effect seeking a review of the judgment rather than rectification.

Ratio Decidendi

The court found that the application did not meet the threshold for rectification of grant as set out in section 74 of the Law of Succession Act and rule 43(1) of the Probate and Administration Rules. The previous judgment had clearly apportioned 0.35 hectares to the applicant and the remainder to the petitioner, and there was no clerical or typographical error in the grant. The applicant was, in substance, seeking a review of the judgment based on new information, which is not permissible under the guise of rectification. The court held that the application was misconceived and unwarranted, and accordingly dismissed it.
