The court held that the protestor, having entered into a sale agreement with the administratrix before she was appointed as such, acquired no rights against the estate. The administratrix had no authority to deal with the estate property prior to her appointment, and any such transaction was void for intermeddling under section 45 of the Law of Succession Act. The protestor was neither a beneficiary nor a creditor of the estate, as the deceased owed him no debt at the time of death and the transaction was not binding on the estate.
