The absence of a supporting affidavit renders the petition defective. However, the court exercised its discretion not to strike out the petition immediately, recognizing that striking out is a drastic remedy. Instead, the court allowed the petitioners an opportunity to amend the petition and file a supporting affidavit within 14 days, in the interest of justice. Costs of the preliminary objection were awarded to the respondent.
