Succession Cause / Ruling on Application for Inventory and Accounts by Administrator

  1. 1 Whether the administrator (widow) can claim absolute ownership of the estate upon transmission to her name.
  2. 2 Whether the administrator is exempt from accounting for the estate after transmission.
  3. 3 Whether the sale of estate assets by the administrator without consent of beneficiaries or court is valid.

Ratio Decidendi

The court held that the administrator, even if a spouse, does not acquire absolute ownership of the estate upon transmission but holds the property in trust for the beneficiaries. The Law of Succession Act imposes a continuing duty on all administrators, including spouses, to render full and accurate accounts and inventories of the estate. Court Disposition

Application allowed in part; respondent ordered to account for the estate.

Orders

  • The respondent to produce for the court an account as provided for by section 83(e) of the Law of Succession Act within 45 days.
  • The prayer for nullification of the disposal of parts of the estate will be dependent on that report.
