Procedural Posture
Miscellaneous Succession Cause / Ruling on Transfer of Succession Cause
Legal Issues
- 1 Whether the Kisumu Chief Magistrate's Court has jurisdiction over the succession cause concerning the estate of Amos Odhiambo Oyucho.
- 2 Whether the succession cause should be transferred to the Maseno SPM's Court where the deceased was domiciled.
Ratio Decidendi
The court determined that both the deceased's domicile and the estate property fall within the jurisdiction of the Maseno SPM's Court, not the Kisumu Chief Magistrate's Court. Accordingly, the proper administration of justice and compliance with jurisdictional requirements necessitate the transfer of the succession cause to the court with territorial jurisdiction over the matter. The court ordered the transfer of Kisumu CM Succession Cause No. E174 of 2024 to Maseno SPM's Court and directed that all necessary documents and consents be filed there before any grant can issue.
Court Disposition
Succession cause transferred to Maseno SPM's Court; Kisumu file closed.
Orders
- Kisumu CM Succession Cause No. E174 of 2024 is transferred to Maseno SPM's Court.
- The original file and this ruling to be transmitted to Maseno SPM's Court.
