There was no contestation of this fact. The court exercised its discretion to review and set aside the dismissal order of 15th April 2024 for want of prosecution. Regarding confirmation of grant and distribution, the court held that the applicable law for distribution in a polygamous family is found in sections 35, 36, 37, 38, and 40 of the Law of Succession Act, which require equal and fair distribution among all beneficiaries, including children...
