The court found that while there was no evidence that the deceased lacked mental capacity to make a will, there were significant suspicious circumstances surrounding the execution of the will dated 15.7.14. The deceased was hospitalized in Nairobi at the time the will was allegedly signed in Vipingo, and the attesting witness could not recall the date of execution. The original will was not produced in court, nor was an authenticated copy annexed to the petition as required by law. The forensic document examiner opined that the signatures on the 2013 and 2014 wills were made by different authors, and the signature on the 2014 will appeared only on the execution page, unlike the 2013 will....
