Succession Cause / Ruling on Application for Grant of Letters of Administration
Legal Issues
- 1 Whether the respondent, as son of the deceased, should be compelled to file a petition for grant of letters of administration within a specified period.
- 2 Whether the applicant should be permitted to file the petition in default by the respondent.
Ratio Decidendi
The court found that since the respondent is the son of the deceased and does not dispute his obligation, he should be directed to file the petition for grant of letters of administration within 30 days. If he fails to do so, the applicant (citor) is at liberty to file the petition. This ensures the estate administration proceeds without undue delay and in accordance with the Law of Succession Act, which prioritizes close relatives in the grant of administration but allows others to apply if those entitled fail to act.
Court Disposition
Application allowed with directions.
Orders
- The respondent, Martin Maobe Momanyi, shall file the petition for grant of letters of administration within 30 days from the date of the ruling.
- In default, the applicant, Francis Nyankerania Mokua, shall be at liberty to file the petition.
