The court found that a DNA test between the applicant (the deceased's brother) and Johnson Gioche Mwangi may provide useful evidence regarding the latter's relationship to the deceased, which is central to the succession dispute. While acknowledging that such a test is not conclusive of paternity, the court held that it is a reasonable and practical step given the circumstances, especially considering the deceased has been dead for over twenty years and exhumation would be costly and complex. The court thus exercised its discretion to order the DNA test between the applicant and Johnson Gioche Mwangi, to be conducted by an accredited institution, with costs to be borne by the applicant.
