Ratio Decidendi

The court found that the deceased was domiciled, lived, worked, and owned the majority of his property in Kisumu, and that most beneficiaries also reside there. There was no sufficient explanation from the respondent as to why the succession cause was filed in Makueni without disclosure to the applicant. The court held that, by virtue of Section 49 of the Law of Succession Act, the proper forum for the succession cause was Kisumu, and that the High Court has the power to transfer the matter to ensure that it is heard in the court with the most substantial connection to the estate and parties. The application to transfer the cause to Kisumu was therefore merited and allowed.
