The property cannot be considered free property of the deceased until the title dispute is resolved in the appropriate forum, namely the Environment and Land Court. The court partially confirmed the grant only in respect of the undisputed parcel, West Kitutu/Mwakibegendi/1197, and ordered that the suit land not be distributed until ownership is determined by the competent court.
