The court found that although there was a written agreement dated 10th April 1966 purporting to sell part of Plot 1550 to Bonuke, the transaction was subject to the requirement for Land Control Board consent under the then-applicable law. No such consent was sought or obtained within three months of the agreement as required by the Kenya (Land Control) (Transitional Provisions) Regulations, 1963 and the Constitution of Kenya, 1963. The consent obtained in 1993, 27 years after the transaction, was outside the scope of the applicable law and therefore null and void.
