Ratio Decidendi

The court found that the order issued on 27th October, 2014 contained an error apparent on the face of the record because the property description relied upon by the court was incorrect. The Certificate of Title clearly showed that the property, Athi River L.R. No. 337/10/26, is registered as I.R. No. 104388, not I.R. No. 86294/20 as previously indicated. Since the error was evident from the record and did not require elaborate reasoning to establish, the applicants satisfied the threshold for review under Order 45 rule 1 of the Civil Procedure Rules, 2010. The court therefore allowed the application and ordered the correction of the property registration details in the previous order.
