Ratio Decidendi

The court found that the application for authorization to sign transfer forms was premature because there was a pending application for revocation of grant, which, by operation of law, suspends all other proceedings relating to the estate until it is determined. Furthermore, the substantive succession cause remained within the jurisdiction of the Thika court, and the High Court was only seized of the revocation application. Therefore, it was not proper to entertain the application before the fate of the revocation application was resolved. The application was dismissed as a result.
