The court held that since Fridah Eunice Odipo has filed an Originating Summons claiming a share of certain assets as matrimonial property, those assets are not 'free property' available for distribution in the succession cause. Rule 41(3) of the Probate and Administration Rules empowers the court to set aside and appropriate contested assets pending determination of such claims in separate proceedings. Although the issue was not raised during the confirmation hearing, the court retains discretion to invoke Rule 41(3) before confirming the grant.
