Ratio Decidendi

Although section 74 of the Law of Succession Act and Rule 43(1) of the Probate and Administration Rules limit rectification to errors in names and descriptions, the court recognized that the inclusion of a newly discovered asset is a substantive change that ordinarily would require a review of the confirmation orders, not mere rectification. However, invoking its inherent jurisdiction under Rule 73, the court determined that it could allow the rectification to include the omitted asset in order to meet the ends of justice, especially where all interested parties had consented. The court thus allowed the rectification and ordered the inclusion and distribution of the asset as sought.
