Ratio Decidendi

The court found that it had not at any point appointed the Public Trustee as administrator of the estate or any part thereof. Therefore, if the Public Trustee holds any property in respect to the estate, it is required by law to make a full account and disclosure to the court. The court deferred consideration of the administrators' request to be appointed as trustees in place of the Public Trustee until such disclosure and accounting is made. The court issued orders for the Public Trustee to file a full written disclosure and account of all assets received and dealings thereon in the estate by a specified mention date, after which further directions would be given.
