Ratio Decidendi

The court found that the bequest of LR No. 214/149 to William Njenga Hinga was an individual gift, not a class gift, as it was expressly made to a named person and not to a class or group. Since William Njenga Hinga predeceased the testator and there was no indication in the will that the gift was intended to pass to other members of a class, the gift lapsed under paragraph 1(1) of the Second Schedule to the Law of Succession Act. The court further held that, pursuant to paragraph 7 of the Second Schedule and clause 6 of the will, the lapsed gift fell into the residue of the estate. The residue was to be distributed equally among the surviving widow and children of the deceased....
