Ratio Decidendi

The court found that the death of one executor and the incapacity of the surviving executor rendered the original grant of probate useless and inoperative. The inability to distribute a key asset of the estate further demonstrated that the administration could not be completed under the current grant. All beneficiaries consented to the revocation and supported the appointment of new executors. The court exercised its discretion under Section 76(e) of the Law of Succession Act to revoke the grant and order the issuance of a fresh grant to the applicants to enable completion of the administration of the estate.
